Competent Authorities in Austria

The resopnsibilities for the regulation of applications of GMOs in Austria are divided between three Federal Ministries. These Competent Authorities are furthermore responsible for implementing the propositions of the Cartagena Protocol:

  • The Federal Ministry of Health and Women (BMGF):
    responsible both for contained use and deliberate release applications (according to Directives 90/219/EEC and 2001/18/EC respectively) notified by industry and research institutions except universities, as well as for GM food and feed applications, according to Regulation (EC) 1829/2003.
  • The Federal Ministry of Science, Research and Economy (BMWFW):
    responsible for contained use and deliberate release applications from Universities and Federal research institutions.
  • The Federal Ministry of Agriculture, Forestry, Environment and Water Management (BMLFUW):
    is involved as additional competent authority for environmental aspects of deliberate release and of placing on the market of GMO-products. The Ministry is supported in its function by Umweltbundesamt.

Scientific advisory bodies for the Austrian competent authorities:

The principal advisory body, the socalled Commission for Gene Technology, was established the Austrian Gene Technology Act to support the competent authorities with expert advice. The Commission is consisting of representatives from the involved Ministries, academia, industry, NGOs and trade unions. The Commission shall give advice with regard to general issues of GMO regulation. Furthermore it shall comment on regulations and ordinances concerning GMO applications and establish technical guidelines to document the technical State of the Art. Additionally the Commission reports regularly to the Austrian Parliament on developments concerning GMO use.

The Commission established three scientific subcommittees. These subcommittees review applications for contained use of potentially dangerous GMOs and for deliberate release of GMOs into the environment, and comment on drafts for additional legislation and measures for implementation of regulations:

  • one of these scientific subcommitees is concerned with applications of GMOs in contained use,
  • another scientific subcommitee is concerned with the issues regarding the deliberate release of GMOs,
  • and a third scientific subcommitee is focused on applications like gene therapy and genetic screening.

A secretariat established at the Federal Ministry of Health and Women  (BMGF) supports the ongoing work of the Commission on Gene Technology. The secretariat is managed by:
